Isn't that down to copyright precedent though? Not a lawyer but I have heard that if companies don't protect their brand, then precedent is set for anyone to use it. Thus even if they were to like Resident Evil 2, if they were to not threaten to sue (if CAPCOM put without permission), then the door is opened for anyone to use the brand without permission.
